Welcome to the Second Chance Online Marketplace (the “Site”). These Terms and Conditions (“Terms”) govern your use of our Site and the purchase of items from Second Chance (“we,” “us,” or “our”).

By placing an order on our Site, you agree to be bound by these Terms. Please read them carefully before completing your purchase.

1. GENERAL & MERCHANDISE CONDITION

• Previously Owned Merchandise: All items listed on our Online Marketplace are pre-owned, salvaged, or donated merchandise.
• Item Photos: Photos in our product listings show the exact item you will receive upon purchase. Please review all listing photos carefully to assess the condition of the item prior to completing your purchase.
• Included Items: Listings include only the items explicitly described in the text. No additional parts, hardware, or accessories are included unless specified.
• No Holds Prior to Purchase: Items listed online remain available to the general public until checkout is completed. We do not place holds on any online merchandise prior to purchase.

2. SALVAGED MATERIALS & LEAD PAINT DISCLAIMER

PLEASE READ CAREFULLY! Many products available on Second Chance’s Online Marketplace have been salvaged or donated from third-party locations with unknown histories.

• Assumption of Lead Risk: If an item features painted or finished surfaces, it should be assumed that the finish contains lead.
• Purchaser Responsibility: The purchaser assumes full responsibility for taking all necessary safety precautions to prevent lead exposure or contamination to themselves, household members, contractors, or any other individuals coming into contact with the purchased item.
• Indemnification: By completing a purchase, the purchaser acknowledges this hazard, voluntarily assumes all associated risks, and agrees to indemnify, defend, and hold harmless Second Chance, its officers, employees, and agents from any and all liability, claims, damages, or legal actions resulting from lead exposure or related safety hazards connected to the purchased items.

3. FULFILLMENT & PICK-UP POLICY

All sales on the Second Chance Online Marketplace are for LOCAL PICK-UP ONLY. We do not provide shipping or freight delivery under any circumstances.

Pick-Up Hours: Orders may be picked up strictly during the following operational hours:

– Monday – Friday: 9:00 AM – 4:00 PM
– Saturday: 8:00 AM – 12:00 PM
– Sunday: CLOSED

4. SOLD AND HOLD POLICY (STORAGE & ABANDONMENT)

• 10-Day Pick-up Window: All purchased items must be picked up within ten (10) calendar days from the date of purchase.
• Unclaimed Items Beyond 10 Days: Any item not collected within ten (10) calendar days of purchase is subject to the following rules:
  • A storage fee of $10.00 per day will begin accruing on Day 11; OR
  • Second Chance reserves the right to cancel the order and put the item back up for resale.
• No Refunds on Forfeited Goods: No refunds will be issued for any items held beyond ten (10) calendar days that are resold or abandoned.

5. RETURNS AND REFUNDS POLICY

Standard Return Policy:

• 10-Day Window: Full-price or original-price items may be returned within ten (10) calendar days from the date of purchase.
• Receipt Required: Original purchase receipt must accompany all returns.
• Restocking Fee: A 15% restocking fee will be deducted from the total refund amount for all authorized returns.
• Initiating a Return: To begin a return, you must contact our Marketplace team prior to returning the item by phone at 443-681-7009 or via our online contact form.

Final Sale & Non-Returnable Items:

The following sales are FINAL and cannot be returned, exchanged, or refunded under any circumstances:

• Discounted Merchandise: Any item purchased at a discount of 15% or more off its original price.
• Specific Categories: All sales of lumber, flooring, windows, doors, mattresses, and boxsprings are final.

6. WAREHOUSE SAFETY & RISK OF LOSS

• Safety Protocols: When picking up merchandise at 1200 West Hamburg Street, customers must follow all staff instructions and posted signs. Customers are responsible for safely loading their own vehicles.
• Transfer of Risk: Risk of loss and damage to merchandise passes to the purchaser immediately upon physical handover at our loading area. Second Chance is not liable for damage incurred during loading, transit, or installation.

7. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without giving effect to any principles of conflicts of law. Any legal dispute or claim arising out of your purchase shall be submitted exclusively to the state courts located in Baltimore City, Maryland.
